This Public Offer (hereinafter \u2013 the \u201cOffer\u201d) constitutes a proposal of the Public Association \u201cRed Crescent National Society of the Kyrgyz Republic\u201d (hereinafter \u2013 the \u201cRCNS KR\u201d), represented by its Head, Mr. Chingiz Tilekovich Dzhakipov, acting under the Charter, hereinafter referred to as the \u201cRecipient\u201d<\/strong>, to enter into a charitable donation agreement (hereinafter \u2013 the \u201cAgreement\u201d) with any individual and\/or legal entity, hereinafter referred to as the \u201cSupporter\u201d<\/strong>, jointly referred to as the \u201cParties\u201d<\/strong>, under the terms and conditions set forth below:<\/p>\n\n\n\n

1. General Provisions<\/strong><\/p>\n\n\n\n

1.1. This proposal is a public offer in accordance with paragraph 2 of Article 398 of the Civil Code of the Kyrgyz Republic. Acceptance of the Offer by the Supporter shall be deemed equivalent to the conclusion of the Agreement under the terms specified herein.<\/p>\n\n\n\n

1.2. The Offer enters into force on the date of its publication on this website.<\/p>\n\n\n\n

1.3. The Offer is open-ended and remains in effect until revoked or replaced by a new Offer published on this website no less than ten (10) business days prior to its entry into force.<\/p>\n\n\n\n

1.4. The Recipient is entitled, at its sole discretion, to terminate this Offer and\/or suspend the acceptance of donations without prior notice and without stating reasons.<\/p>\n\n\n\n

1.5. The invalidity of one or more provisions of the Offer shall not render the remaining provisions invalid.<\/p>\n\n\n\n

1.6. Any individual or legal entity may accept this Offer and thereby enter into the Agreement with the Recipient.<\/p>\n\n\n\n

1.7. The date of acceptance of the Offer shall be the date the donation is made; accordingly, the date of conclusion of the Agreement shall be the date the funds are credited to the Recipient\u2019s bank account.<\/p>\n\n\n\n

1.8. The place of conclusion of the Agreement shall be deemed the city of Bishkek, Kyrgyz Republic.<\/p>\n\n\n\n

1.9. This Offer shall be governed by and construed in accordance with the legislation of the Kyrgyz Republic.<\/p>\n\n\n\n

2. Subject of the Agreement<\/strong><\/p>\n\n\n\n

2.1. The Supporter voluntarily and gratuitously transfers to the ownership of the Recipient monetary funds in an amount determined by the Supporter (hereinafter \u2013 the \u201cDonation\u201d), and the Recipient accepts the Donation and undertakes to use it for the purposes of carrying out its statutory activities, as well as the activities provided for in the Law \u201cOn the National Society of the Red Crescent of the Kyrgyz Republic\u201d dated 3 February 2018 No. 19.<\/p>\n\n\n\n

2.2. The actions performed by the Supporter under this Agreement constitute a donation in accordance with the Law \u201cOn Patronage and Charitable Activities.\u201d<\/p>\n\n\n\n

3. Procedure for Transfer of the Donation and Other Conditions<\/strong><\/p>\n\n\n\n

3.1. The Supporter independently determines the amount of the voluntary Donation and transfers it to the Recipient by any payment method indicated on the website (website link), under the terms of this Agreement.<\/p>\n\n\n\n

3.2. The Supporter confirms that he\/she\/it is entitled to make the Donation independently or has obtained all necessary consents and authorizations for making the Donation. The Parties hereby confirm that they are not aware of any circumstances or claims preventing the transfer of the Donation to the Recipient.<\/p>\n\n\n\n

3.3. The fact of transferring the Donation to the Recipient shall constitute the full and unconditional acceptance by the Supporter of the terms of this Offer.<\/p>\n\n\n\n

3.4. The Supporter may subscribe to regular Donations by selecting the relevant option on the official website of the Recipient (website link). In such case, the Supporter agrees that the Donation will be made automatically every thirty (30) days in the same amount as the first Donation made by the Supporter. The Donation amount may be subsequently amended by agreement of the Parties, subject to the Supporter\u2019s consent to such amendment.<\/p>\n\n\n\n

3.5. The Supporter has the right to withdraw from making regular Donations by sending a corresponding notice to an authorized staff member of the RCNS KR in one of the following ways:<\/p>\n\n\n\n

  1. By phone at the number indicated on this website;<\/li>\n\n\n\n
  2. By sending a message via the contact forms available on this website;<\/li>\n\n\n\n
  3. By sending an email to: donate@redcrescent.kg;<\/li>\n\n\n\n
  4. In person, by visiting the office of the RCNS KR and notifying the authorized staff member.<\/li>\n<\/ol>\n\n\n\n

    The notice shall be deemed received at the time it is actually received by the authorized staff member of the RCNS KR. Upon receipt of the notice, regular Donations shall cease as of the date specified in the notice, or, if no date is specified, as of the date of receipt of the notice.<\/p>\n\n\n\n

    3.6. The Recipient may notify the Supporter of ongoing programs through electronic, postal, and SMS mailings, as well as through telephone calls.<\/p>\n\n\n\n

    3.7. The Recipient publishes annual reports (Bulletins) on the use of Donations on its website. Upon request of the Supporter (in electronic or written form), the Recipient shall provide information regarding the Donations made by the Supporter.<\/p>\n\n\n\n

    3.8. The Recipient shall bear no obligations towards the Supporter other than those expressly set forth in this Agreement.<\/p>\n\n\n\n

    3.9. Donations transferred to the Recipient under this Offer are voluntary and gratuitous. Donations shall not be refunded, in whole or in part, except as expressly provided by the legislation of the Kyrgyz Republic.<\/p>\n\n\n\n

    4. Rights and Obligations of the Parties<\/strong><\/p>\n\n\n\n

    4.1. Any disagreements and disputes arising between the Parties in connection with or as a result of this Offer and\/or the Agreement shall be resolved through negotiations.<\/p>\n\n\n\n

    4.2. The Parties shall be responsible for the accuracy of the information provided to each other.<\/p>\n\n\n\n

    4.3. For failure or improper performance of obligations under the Agreement, the Parties shall be liable in accordance with the legislation of the Kyrgyz Republic.<\/p>\n\n\n\n

    4.4. This Offer and the Agreement shall be governed by and construed in accordance with the legislation of the Kyrgyz Republic. Any disputes, disagreements, or claims arising out of or in connection with this Offer and\/or the Agreement, including those related to their performance, breach, termination, or invalidity, if not settled through negotiations, shall be resolved by the competent courts at the location of the Recipient, in accordance with the legislation of the Kyrgyz Republic.<\/p>\n\n\n\n

    5. Processing of Personal Data of Supporters \u2013 Individuals<\/strong><\/p>\n\n\n\n

    5.1. By accepting the Offer, the Supporter \u2013 individual grants the Recipient consent to the collection, storage, and processing of his\/her personal data provided when making the Donation (surname, name, patronymic, mobile phone number, email address, and other data), including transfer to third parties, for the purpose of fulfilling obligations arising from or in connection with the conclusion of the Agreement, including the following actions: collection, recording, systematization, accumulation, storage, updating (modification), retrieval, use, transfer (distribution, provision, access), anonymization, blocking, deletion, and destruction of personal data.<\/p>\n\n\n\n

    5.2. This consent shall remain valid until the expiration of the retention periods for personal data or documents containing such data, as determined in accordance with the legislation of the Kyrgyz Republic.<\/p>\n\n\n\n

    6. Use of Information about Supporters \u2013 Legal Entities<\/strong><\/p>\n\n\n\n

    By accepting the Offer, the Supporter \u2013 legal entity grants the Recipient consent and the right to process information provided by the Supporter when making the Donation (name, location, donation amount, and other details), including transfer to third parties, for the purpose of fulfilling obligations arising from or in connection with the conclusion of the Agreement.<\/p>\n\n\n\n
